Human and Civil Liberties Policy
for Foundation Academies

Purpose
The purpose of this policy is to affirm Foundation Academies' unwavering commitment to fostering a safe, inclusive, and supportive educational environment for all scholars and their families. This includes safeguarding the dignity and rights of every individual, regardless of immigration status, race, religion, gender identity, or other characteristics. Our goal is to ensure that no one within our community faces discrimination, intimidation, or fear while in our care.

Policy Statement
Foundation Academies honors the Human and Civil Liberties of all people, committed to protecting the safety and well-being of all scholars and their families by:

  • Prohibiting the release of personal information to immigration enforcement agencies unless legally required.

  • Restricting access to school property by immigration enforcement agents without valid legal documentation.

  • Offering resources and support to Scholars and families experiencing immigration-related challenges.

Key Commitments

1. Safe Environment

  • Scholars have the right to learn in a space free from fear of discrimination or deportation.

  • Staff will not inquire about or disclose a Scholar or family member's immigration status unless required by law.

2. Restricted Access

  • Immigration enforcement agents must present a valid warrant signed by a federal or state judge to access school property.

  • Any inquiries from immigration enforcement agents will be directed to the CEO or their designated representative.

3. Confidentiality

  • The privacy of Scholar and family records will be strictly maintained.

  • Requests for Scholar information from external parties will be handled in compliance with the Family Educational Rights and Privacy Act (FERPA) and other applicable laws.

4. Support Services

  • The school will connect Scholars and families with legal, counseling, and social services as needed.

  • Staff will receive training to address immigration-related concerns with sensitivity and discretion.

5. Non-Discrimination

  • Discrimination based on immigration status or perceived immigration status is strictly prohibited in all school programs and activities.

Legal Compliance

  • Foundation Academies will adhere to all applicable local, state, and federal laws while prioritizing the safety and well-being of scholars.

Review and Oversight

  • The Foundation Academies Board of Trustees will review this policy annually to ensure its continued effectiveness and alignment with legal requirements and community needs. The Foundation Academies reserves the right to amend this policy at any time. 

By adopting this Human and Civil Liberties Policy, Foundation Academies reaffirms its dedication to creating a safe and inclusive learning environment where every scholar and family can thrive without fear.
